The Rukungiri Chief Magistrate sitting in Kanungu, His Worship Patrick Bamuhiga, has adjourned the election petition challenging the re-election of Kanungu District Speaker Frank Byaruhanga to 22nd October, 2025 when a ruling on whether the court has jurisdiction to hear the matter.
His Worship Bamuhiga adjourned the matter after hearing a preliminary objection raised by Byaruhanga’s lawyers.
The Lawyers for Speaker Byaruhanga told court that the Grade One Magistrate’s Court has no powers to hear a district speaker election petition, arguing that such matters should be heard by the High Court.
However, the petitioner, Ms Immaculate Birungi — the Female District Councillor for Kanungu Town Council, through her lawyers from Byamugisha Gabriel & Company Advocates opposed the objection, insisting that the Magistrate’s Court has powers to hear the petition and asked court to proceed.
Ms Birungi challenged Byaruhanga’s election after the speakership vote ended in a 26-26 tie, with District Chairperson Francis Byamukama Kapesha casting the deciding vote in favor of Byaruhanga.
