KAMPALA- The High Court in Kampala has ordered prosecutors in the Katanga murder trial to disclose all raw data in the form of text messages, WhatsApp messages, phone call data, and CCTV footage recovered from the Katanga residence that the cybercrime expert relied on to write his report.
The order by Justice Isaac Muwata to chief prosecutors; Jonathan Muwaganya and Samalie Wakooli comes days after defense lawyers from KAA put up a spirited fight to block the evidence of AIP Enock Kanene, a cybercrime expert who analyzed the phones of the five suspects and CCTV footage.
As Kanene proceeded to testify on his report, defense lawyers protested, arguing that he had violated several sections of the Computer Misuse Act in retrieving and analyzing the gadgets.
Justice Muwata stressed that timely disclosure of evidence, whether it strengthens or weakens the prosecution’s case, is a vital element in a fair trial.
He therefore ordered that other scientific pieces of evidence, even those the defense has not specifically requested for , should be disclosed to the defense team before the next hearing date on Thursday this week.
Kanene will be the 10th prosecution witness to testify in the trial against the widow Molly Katanga, her two daughters Martha Nkwanzi and Patricia Kankwanzi, the family shamba boy George Amanyire and Charles Otai, a nursing officer.
