KAMPALA- Prosecution in the Katanga Murder trial has presented its 10th witness ; an Assistant Inspector of Police Enock Kanene ; a Cyber-crimes analyst who examined the accused’s’ phones and CCTv footage from the Katanga residence to determine if there is any information regarding the alleged shooting and death of 2nd/ November 2023.
Kanene has told court that he received police requests to extract, examine and analyse data on the exhibited phones belonging to 5 suspects, a DVC video recorder and Flash disc obtained from the Katanga master bedroom and CCTv footage to find out if there is any information regarding the shooting of Henry Katanga.
But as soon he proceeded to testify on his 30th / April 2024 report containing the findings of the analysis, the defence team led by Elison Karuhanga raised an objection regarding the manner in which Kanene obtained the phones and the CCTv footage from the Katanga residence.
The lawyers have then moved court to block AIP kanene from testifying while citing violations of several sections of the Computer Misuse Act.
They claim that AIP Enock Kanene retrieved the CCTV footage without a valid search warrant authorising him to so in addition to illegally holding mobile phones of the five suspects for more than 72 hours without a court order.
The defense team now argues that AIP Kanene cannot testify on any information, data, or videos obtained from the suspects’ electronic devices, as doing so would be unconstitutional and prejudicial to principles of a fair trial.
Kanene had earlier testified that the request to extract and analyze data from the mobile phones of Molly Katanga, Martha Nkwanzi, Patricia Kakwanzi, George Amanyiire, Charles Otai, and the late Henry Katanga, to determine whether it is related to the shooting was made to him through police form 17 A from Jinja Road police station.
However state prosecutor asked up to tomorrow to respond to the defense team’s objection.
