The Chief Magistrate’s Court sitting at Nakawa and presided over by her Worship Christine Natenge has today rejected the State’s application to access data from the phones of Dr Kizza Besigye and Hajji Obeid Lutale.
This comes after the Director of Public Prosecutions (DPP) filed an application before the Nakawa Chief Magistrates Court seeking to access, analyze and extract data from the phones of Dr Kizza Besigye and his co-accused, Obeid Lutaale, who are facing charges of treason and misprision of treason.
The application filed on March 5th 2025, was brought to the attention of the Court last week on Friday when Dr Kizza Besigye, Lutaale and their third accused person, Captain Denis Oola, returned before the Court presided over by the Chief Magistrate Esther Nyandoi for an update on the progress of the investigations into charges against them.
However, Chief Magistrate Natenge has now ruled that she lacked jurisdiction to grant the order, noting that the accused had already been committed to the High Court which threw Dr Kizza Besigye’s supporters who were in court in celebrations.
After the ruling, Dr Kizza Besigye and his co-accused were taken back to Luzira Upper Prison awaiting when they will appear in the High Court for trial of the charges against them.
