KAMPALA- Dr. Kiiza Besigye Wallen Kifefe and Hajji Obeid Lutale were on Monday, December 2nd 2024 further remanded for another week after her lead Kenyan lawyer Martha Karua shows up in court with no practicing certificate from the Uganda Law council.
In such circumstances the court would not proceed to her the duo’s case as it’s a pre-requisite for every lawyer to possess and furnish court with a certificate from the law Council.
However Besigye’s Ugandan Lawyer Elias Lukwago had asked that the matter be adjourned to tomorrow because the Law council has agreed to issue Karua with a temporary practicing certificate;
But the court checked its calendar and Tuesday next week was the only available date to hear Dr. Besigye and Hajji Lutale.
The two were arrested from Riverside Hotel in Nairobi Kenya and arraigned before the General Court Martial on 20th November 2024 to face charges of unlawful possession of 2 pistols and live ammunition.
They are said to have committed the offences in the cities of Athens in Greece, Geneva in Switzerland and Nairobi Kenya where they allegedly held meetings aimed at soliciting logistical support and identifying military targets in Uganda with intention of prejudicing security.
The pair denied the charges and was remanded to Luzira prison as the UPDF continued with its investigations.
However today , the two had to come back to receive a ruling on the legality of the charges and jurisdiction of the General Court Martial given the fact that they were arrested from the neighboring Kenya .
This has not been possible even with the over 35 lawyers who have been present in court today and the court martial chairman Brig. Gen Freeman Mugabe remanded them back to prison until 10th/ December .
