KAMPALA- The High Court in Kampala has nullified the election of Makindye East II Lord Councillor Ivan Wafula and replaced him with NRM’s Yasin Omari Assini.
This is after Judge Musa Ssekaana discovered that Wafula was illegally nominated for the January 25th 2021 elections after he forged academic documents.
However, the Returning Officer declared Wafula the winner despite Yasin receiving 2,277 votes, while Wafula garnered 1,753 votes but the Electoral Commission declared NUP’s Wafula as winner.
Dissatisfied with the results, Yasin petitioned the Magistrates Court, alleging the election was marred by irregularities and non-compliance with the electoral laws including telling lies on oath that he possessed adquate academic qualifications and he graduated as a teacher whereas not.
He also claimed Wafula’s win resulted from falsified and altered results.
The lower court dismissed the petition, declaring Wafula the duly elected councilor.
Dissatisfied again, Yasin appealed to High Court which has overturned the Lower court decision and declared him as the duly elected Lord Councilor.
Following the High Court’s decision, Yasin Omar has been sworn as the new Lord Councilor for Makindye East II Constituency to continue with the remaining part of the term until 2026 elections.
