Officials engaging Locals on the ongoing Land wrangle

NEWS- The Kabale Chief Magistrate, His Worship Derrick Byamugisha, has scheduled the 20th March 2024 for the mention of the application in which Kibahigiire Veleriano Kambamu accuses the Rukiga Resident District Commissioner, Fred Nayebare Kyamuzigita, and eight others of defying a court order.

The court had previously issued an order to stop them from using the land until the hearing for the temporary injunction application filed by Kibahigiire.

On the 4th October 2023, under Civil Suit Number 36 of 2023 before the Kabale Magistrate Court, Kibahigiire filed a lawsuit against Rukiga Resident District Commissioner Fred Nayebare Kyamuzigita and eight others for encroaching and trespassing on her land. They were also accused of destroying the land fence made of barbed wire.

On the 20th October 2023, His Worship Byamugisha visited the contested land in Nyabubaare cell, Rwenyangye parish, Kamwezi Sub County, Rukiga district, to verify the allegations before the court. He directed all the defendants to cease from using the land until the court commenced hearing the application for a temporary injunction filed by Kibahigiire.

However, the defendants reportedly defied the court order and continued encroaching and trespassing on the contested land. This prompted Kibahigiire to file an application of contempt against the RDC and his associates.

During the previous court session, His Worship Byamugisha set the 20th March 2024 as the date when he will commence hearing the application filed by Kibahigiire. Kibahigiire’s lawyer, Collins Nuwagaba, stated that the actions of encroaching and trespassing warranted civil imprisonment due to their total defiance of the court order.
