KAMPALA- The Uganda Law Society (ULS) and its head of election committee Moses Mwase have been dragged to the Higher court for orders to stop the forthcoming elections scheduled for December 17 to elect representative to the Judicial Service Commission.
The petition has been filed by Pheona Nabasa Gladys Wall; a former ULS president who accuses the lawyer’s umbrella body together with Mwase for allegedly omitting her name from the final nomination list.
Nabasa is now seeking for a court’s order against Mwase and ULS quashing their impugned decision to exclude her from the list.
Nabasa further seeks an order directing the respondents to hold elections of ULS representatives to JSC in compliance to the principles of equity and neutrality.
According to her application , Nabasa states that on November 26, ULS issued/ published a notice of election of JSC nominees of the ULS to be held on December 17 wherein potential candidates where invited to submit the prerequisite requirements for their nomination.
That she duly complied with the said notice and on December 3, 2024, Nabasa duly submitted her nomination documents which were verified and duly certified by the Election committee that she was eligible for the said position.
That Upon nomination , Court documents reveal that Nabasa received a phone call from Mwase, informing her of an official written complaint against her nomination. She promptly returned to the nomination room at 7:00 pm, where the alleged complainant was summoned and denied making the complaint. With no complaint substantiated, Nabasa resumed her campaigns.
That to her dismay of the applicant on the same evening of December 3, ULS president which is the appointing authority of the Elections Committee headed by Mwase circulated a list of the nominated candidates without that name bearing the signature of Mwase on the official letterhead of ULS on his personal X platform.
She seeks for a court order that ULS and Mwase pays general damages for inconvenience, reputational damage mental and psychological anguish she has suffered as a respected public figure and former president of ULS.
